Terms of Service

By accessing, browsing, registering an account on, or interacting with Odemny, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms of Service in full, along with our Privacy Policy and Geopolitical Charter.

If you are using the Service on behalf of an educational school district, academic institution, or commercial entity, you represent and warrant that you hold legitimate administrative authority to bind that entity to these Terms. If you do not have such authority, or if you or your institution disagree with any provision, you must immediately cease all access and prohibit your users from utilizing Odemny.

Odemny is distributed, delivered, and operated strictly on an "AS IS" and "AS AVAILABLE" basis. We make no representations, guarantees, or warranties regarding continuous uptime, system availability, network latency, or accuracy of search indices.

Without limiting the generality of the foregoing, Odemny makes no warranty that (a) the Service will meet your specific academic or operational criteria; (b) the Service will be uninterrupted, error-free, malware-free, or compatible with institutional filtering firewalls; or (c) any defective outputs or indexed search artifacts will be corrected.

To protect the infrastructural sustainability of Odemny, operator liability is reduced to the maximum extent permissible by law. Under no conditions shall Odemny or its creators be held liable for monetary or intangible damages arising from the use or inability to use the platform.

Financial Liability Cap: In any circumstance where liability cannot be entirely disclaimed under governing statute, you agree that the aggregate liability of Odemny and its operators shall be strictly capped at the lower of (i) the total monetary amount actually paid by you to Odemny for paid services during the three (3) months preceding the incident, or (ii) zero dollars ($0.00 USD / NT$0) if you have utilized the free tier of the platform.

Odemny disclaims all implied warranties of merchantability, fitness for a particular educational purpose, title, non-infringement, and quiet enjoyment.

• No Academic Warranty: Odemny makes no certification that indexed resources adhere to standard curriculum benchmarks or school pedagogical mandates.
• No Security Warranty: While modern cryptographic hashing (salted PBKDF2/SHA-256) and TLS 1.3 encryption are implemented, Odemny does not guarantee absolute invulnerability against sophisticated state-sponsored cyber warfare or network-level interceptors.
• No Uptime SLA: Odemny does not commit to any Service Level Agreement (SLA). Maintenance windows, server reboots, and architectural refactoring may occur at any time without advance warning.

Access to Odemny accounts and the Odemny Identity Service (OIS) is a revocable privilege, not a property right. We enforce a strict Zero-Tolerance Abuse & Disrespect Policy.

Odemny reserves the absolute, unilateral, and unreviewable authority to restrict, lock, terminate, suspend, or completely purge any account identifier, cryptographic token, or IP block at any moment, with or without cause, and without prior notice or administrative liability. Conduct that triggers immediate termination includes, but is not limited to:

• Disrespectful, hostile, abusive, or threatening behavior directed at platform contributors, developers, or affiliated community members.
• Automated scraping, denial-of-service attempts, credential-stuffing attacks, or unauthorized penetration tests targeting OIS infrastructure.
• Attempting to circumvent geolocation filters, regional exclusions, or rate limiters.

Irreversible Account Deletion Protocol: When an account deletion is executed by the user (via Settings or OIS challenge), all profile records across the database tables (including users and odemny_accounts) are permanently erased. This operation cannot be reversed, and purged data cannot be retrieved.

All monetary transactions, donations, paid tier upgrades, subscription extensions, or pro licenses acquired through Odemny (including credit card, crypto, or third-party merchant processing) are absolute, final, and non-negotiable.

Odemny maintains a strict 100% No-Refunds Policy. No partial, pro-rated, or conditional refunds will be granted under any circumstance, including platform downtime, service discontinuation, technical incompatibility, or account termination pursuant to Section 5.

Odemny delivers backend routing and indexing utilities; however, the Educational Institution, district, or network administrator is the sole curator of its internal domain access rules and content whitelists.

• Monitoring Obligation: Odemny does not actively supervise, police, or log student screen interactions. Educational institutions assume 100% responsibility for monitoring student browsing and ensuring compliance with local pedagogical rules.
• COPPA Institutional Compliance: Institutions are strictly prohibited from provisioning student logins with personally identifiable information (PII) such as student real names, home addresses, or phone numbers. Schools must provision anonymized or pseudo-anonymous accounts. Breaches of this obligation remain the sole liability of the school district.

Odemny queries and displays links to external, third-party internet locations. Odemny neither authors, monitors, endorses, nor exercises editorial control over third-party materials. We carry zero responsibility for inaccurate, offensive, pirated, or malicious content hosted on outside domains.

Advertising Notice: Odemny may incorporate programmatic advertising networks, sponsored search indices, and affiliate references to finance infrastructure maintenance. Third-party ad partners may deliver automated marketing modules over the interface. Odemny is not responsible for products or services marketed by outside ad networks.

Odemny operates strictly under the legal and democratic principles of Taipei jurisdiction, recognizing Taiwan (Republic of China) as a sovereign democratic nation.

Extraterritorial Rejection: Odemny unequivocally rejects all legal claims, administrative directives, surveillance requests, and censorship orders issued by the People's Republic of China (PRC), the Russian Federation, or other authoritarian entities. In accordance with data integrity guidelines and regional security frameworks (including CSL, DSL, and PIPL restrictions), users operating under PRC administrative jurisdiction are excluded from utilizing Odemny account services.

You agree to defend, indemnify, and hold harmless Odemny, its developers, operators, contributors, infrastructure providers, and affiliates from and against any claims, losses, liabilities, damages, judgments, awards, costs, and legal fees arising out of or resulting from:

• Your access to, usage of, or misuse of the Service.
• Your violation of any provision of these Terms of Service.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Any student data provisioning violation executed by your educational institution.

Modifications: Odemny reserves the right to modify or revise these Terms at any time without individual direct notification. The updated effective date will be posted at the top of this document. Continued usage of the Service after any modification constitutes binding acceptance of the updated terms.

Severability: If any provision of these Terms is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed and shall not affect the validity or enforceability of any remaining provisions.

Dispute Resolution: Any disputes, claims, or controversies arising from or relating to these Terms shall be resolved exclusively through final and binding arbitration in accordance with democratic commercial arbitration rules under Taipei jurisdiction.
